Adani Group to takeover Jaypee Associates after creditors nod

Lenders of Jaiprakash Associates have chosen the Adani Group to take over the company which has been in deep financial trouble for years. The firm is currently in the insolvency process due to heavy debt. rnAdani Enterprises received a Letter of Intent on November 19 confirming that creditors want the Adani plan. The takeover now needs approval from the National Company Law Tribunal in Allahabad. After clearance the Adani Group can implement the plan through any of its companies. rnReports say the deal is close to 1.5 billion dollars. Jaiprakash Associates has businesses in cement construction power real estate hotels and fertilizers. rnOther bidders included Vedanta Dalmia Bharat PNC Infratech and Jindal Power. Vedanta had made the highest bid but lenders preferred Adani because it offered a stronger upfront payment and a more secure plan. rnJaiprakash Associates owes around 55,000 crore rupees and entered insolvency in June 2024 . The National Asset Reconstruction Company is the biggest lender in the process.

YEIDA Warns Suraksha Group Over Big Housing Project Delays The Yamuna Expressway Industrial Development Authority (YEIDA) has sent a warning letter to the Suraksha Group. This company is in charge of completing and giving possession of about 20,000 flats in the stalled Jaypee Infratech Limited (JIL) projects in Noida and Greater Noida. Suraksha Group took control of JIL on May 24, 2024, with a promise to restart construction within 90 days. The plan was meant to help thousands of families who have been waiting for their homes for years. But buyers say that there has been very little progress since then. Why YEIDA Sent the Notice YEIDA has given Suraksha one week to answer 14 questions about the delays. They want to know why construction is slow, why enough workers are not on site, and why the company has not put in the promised money to speed up the work. A copy of the notice shows that YEIDA also asked about: • No visible progress at the site • Shortage of labour • No structural safety reports shared with buyers • Charging buyers extra even when amenities are not ready • Not following RERA rules • Not creating separate bank accounts for each project to protect funds Homebuyers’ Complaints Buyers from Jaypee Wish Town in Noida’s sectors 128, 129, and 130 say Suraksha has failed to keep its promises made in March 2023. They say Suraksha promised to put ?3,000 crore into the projects and complete work on nine stalled projects but has not done so. Out of 97 towers, tenders were issued for only 41 towers and work stopped after the earlier contractor was removed. Buyers also say that: • The promised mobile app to share updates has not been launched • Important managers have resigned, which caused more delays • The company is not sharing construction updates or audit reports YEIDA says if Suraksha does not give a proper reply in 7 days, further action will be taken. The buyers want YEIDA to monitor the projects regularly to make sure work is done according to the approved plan. Suraksha Group has not given any public statement yet.

rnJaypee Infratech’s homebuyers have approached NCLAT due to the incompetency of Suraksha Group to fulfil its promise to start the construction work within 3 months of the resolution plan passed. rnJaypee Infratech Real Estate Allottees Welfare Society (JREAWS) had submitted a petition in NCLAT over the project delays. In their petition, they said that the Suraksha Group had not kept the promises they made when they took over JIL in March 2023 through a resolution plan and then again in May 2024 in the appellate tribunal. These promises were in the resolution plans in the NCLAT proceedings. rnThey failed to mobilise the 3000 crore required for construction, deploy workers, or even open an escrow account, as specified in the resolution plan. Resolution Plan: May 2024 rnAccording to the resolution plan passed this year, in May, Suraksha Group was required to fulfil the following promises: • Construction will commence in 90 days. • Infuse Rs. 3000 crore into the construction of nine towers. • Development of a mobile app for regular updates • Commencement of work in 97 towers • Transparency in structural audits. rnThe buyers have alleged that, instead of fulfilling these promises, Suraksha Group is only satisfying their needs. Such as: • Stripping of assets • Increased transfer charges • and also lack of transparency in the structural audit. Allegations of homebuyers in petition rnJaypee Infratech’s homebuyers have alleged that, rather than fulfilling their promises, they are busy in looking for sources of money extraction. They have increased transfer charges significantly and are also selling individual Jaypee assets to generate more revenue for themselves. rnThe tribunal heard the appeal by buyers on Dec 10 and issued notices to Suraksha, JIL, the Insolvency and Bankruptcy Board of India (IBBI), and Anuj Jain, the former interim resolution professional (IRP). We have scheduled the next hearing for Jan 8. JREAWS' President Ashish Mohan Gupta Allegations “There is no fund has been infused so far that would push the construction of the projects,” said JREAWS president Ashish Mohan Gupta, referring to the promise made by Suraksha, who was supposed to arrange 3000 cores for the commencement of the construction work. rnHomebuyers said, "They have been waiting for their flats for decades, and even after the resolution plan was passed, the construction of their flats has been ceased." rnEven the limited work undertaken during the IRP regime had been stopped after the previous contractor’s removal. Suraksha was supposed to commence the work in all the 97 towers but the tender floated in May only incorporates 41 towers with no progress on the remaining 57. Instability in Suraksha Leadership rnHomebuyers said, “Suraksha is witnessing immense instability in their leadership; big faces, including Aalok Dave (executive director, managing director, and CEO), quit on Nov 30, while Suresh Bansal (additional executive director) left on Aug 17. rnIf Suraksha's leadership is unstable, how will they focus on building the remaining projects? Increased Transfer Charges rnHomebuyers also alleged that the Suraksha group has increased the transfer charges unreasonably, demanding over 8000 per sqft for unsold units, which is significantly higher than 4,575 estimated in the resolution plan. What has Suraksha Group Sources claimed? rnSuraksha said it had secured a Rs 125-crore loan, a Rs 3,000-crore credit line and fixed savings worth Rs 1,000 crore to pay for the project. The group will build homes for 1,700 people in Wish Town, Mirzapur, and Agra over the next four years, according to the settlement plan. rnSources inside the company said that the different steps of GRAP that have been in place since November have hurt construction. The sellers' patience is running out. "Enough is enough of the wait. Too many unnecessary delays are making our dreams of buying a home fade. "We need to do something right now on the ground," Gupta said.

Suraksha Group Awards Tenders for 41 Jaypee Infratech Towers

Construction is finally set to resume on the long-delayed residential projects by Jaypee Infratech Limited (JIL). The Suraksha Group, which recently took over the struggling real estate company, has awarded contracts to build 41 out of 97 towers across nine different projects. This decision is a huge relief for over 10,000 homebuyers who have been waiting for their homes for more than a decade. Suraksha Group officially took control of JIL on May 24 this year, after a court order confirmed their takeover and required them to pay Rs 1,335 crore to the Yamuna Expressway Industrial Development Authority (YEIDA) for farmers’ compensation. The court also directed them to follow a plan that benefits both homebuyers and farmers. According to this plan, Suraksha had to start construction within 90 days of the court’s order. The plan includes building homes for more than 17,000 buyers in areas like Wish Town, Mirzapur, and Agra. The total cost of finishing these projects is over Rs 6,400 crore. To manage this, Suraksha has secured a Rs 125 crore debt facility, a Rs 3,000 crore credit line, and has Rs 1,000 crore in fixed deposits. Right now, work is ongoing on four projects-Kosmos, Klassic, Kensington Boulevard, and Kensington Park Apartments-covering 62 towers and involving 6,067 buyers. However, work on 15 towers in Kosmos and Kensington Boulevard hasn't started yet. For the other seven projects, which include 82 towers, no work has been done for the past decade, affecting 9,727 buyers. To avoid further delays, Suraksha has divided the work among several contractors for each project. This way, if one contractor faces issues, others can continue the work. The new management has also appointed a new board of directors to improve transparency and governance, and they have taken control of the construction sites and hired security teams. Previously, construction was halted in June when the Insolvency and Bankruptcy Code (IBC) process for JIL was started. Suraksha is now working directly with JIL's contractors to keep the projects on track. Contractors for 41 towers in Wish Town are starting to deploy workers, although equipment is still being moved from JIL. Full construction will begin once this is completed. Contractors have been asked to open special accounts to track how funds are used. Suraksha has also applied to renew the project's registration with the UP-RERA (Uttar Pradesh Real Estate Regulatory Authority) and is setting up committees to monitor the progress of each project and keep buyers informed.

The GNIDA office has already registered 220 people at its registration camps. On November 3 (Thursday), SJP hotels and resorts (Migsun) conducted a registry of all properties, while Aashtha intelligence took place on November 4. During this camp, 34 people registered their flats, according to officials. Aims Golf Town registered homes on November 7, Panchsheel Buildtech on November 9, Pigeon Buildhome registered homes on November 10, Kamrup Infrabuild registered homes on November 11, and Arihant Infra Realtors registered homes on November 14 Omkar Next on November 16th and Mahalaxmi on November 15. The Reserve Bank of India (RBI) has directed banks to refer as many as 50 dud accounts to bankruptcy court if they are unable to find a resolution for them in about three months, in the second such list that the regulator has sent out in its renewed campaign to clean up the country's overwhelming bad corporate debt problem. The move will not only put pressure on promoters to come up with workable recast strategies but also pinch banks even more as they will have to make higher provisions on loans of companies referred to the insolvency process. A senior bank official said each bank has got a separate list from the RBI. Based on conversations with bankers, ET estimates the number of corporate accounts involved at 45-50 with about Rs 2 lakh crore in outstanding loans. It was in June that RBI had sent out the first list of 12 accounts that added up to about Rs 2.5 lakh crore in money owed. Source : Economic Times Buyers of Jaypee Wish Town have started an online petition directed to the management of the Industrial Development Bank of India (IDBI), seeking amnesty for Jaypee Infratech from an impending declaration of bankruptcy. The appeal harps that invested buyers should not have to bear the brunt of Jaypee's financial situation. The campaign, floated on online platform Change.org has been started following a directive from the Reserve Bank of India in June to all lending banks to Jaypee group to file an application under insolvency and bankruptcy code (IBC) with the National Company Law Tribunal. The push came from the apex bank after several lenders to Jaypee flagged its debts as non-performing assets or bad debts. So far 1265 Wish Town buyers have signed it. The campaign has been undersigned by Arvind Jain, president of Developers Township Property Owners Welfare Society, the apex association for all buyers of Jaypee Wishtown apartments. The appeal has been marked to Mukesh Kumar Jain, MD and CEO, IDBI Bank. The appeal is titled: "Save 25000 buyers of Jaypee by preventing them from filing bankruptcy." "We were told that the construction at Wishtown is in process. We are informed that the builder has procured Rs1800 crore as working capital for the completion of the project. Jaypee Infratech is among the 12 firms identified by the central bank with a combined debt of over thousands crore, for proceedings under the newly enacted Insolvency and Bankruptcy Code, 2016. Other accounts identified by RBI include Essar Steel, Bhushan Steel, Electrosteel Steel, Alok Industries, Jyoti Structures, Monnet Ispat and Lanko Infratech. According to RBI, 12 bad loan accounts owe Rs 2.5 trillion to the system, which constitute around 25 per cent of gross bad loans. Delhi NCR to get 2nd International Airport in Greater Noida's Jewar

The aviation ministry granted approval to the second international airport in greater noida's jewar. "We have granted in-principle approval for a greenfield airport at Jewar (Greater Noida) to cater to the growing flying requirements of NCR," aviation minister Ashok Gajapati Raju told reporters. He added that the NOIDA International Airport will cater to 30-50 million passengers per year over the next 10-15 years. "The area notified for Noida Airport is 3000 hectares. The 1st phase of Jewar Airport will be developed in 1000 hectares. We expect up to Rs 20,000 crores of investment into the project," Raju further said. The proposed Jewar international airport has moved a step ahead with the Ministry of Defence giving formal no-objection certificate for the ambitious project in Greater Noida, adjoining the National Capital Region of Delhi. Sources said the NOC was given only last month after BJP MP from Gautam Buddh Nagar and former minister of state for civil aviation Mahesh Sharma sought a push for developing airports in small towns as part of regional air connectivity scheme. The Jewar airport project was also taken up keenly by the previous Mayawati government in UP. In fact, the project was one of the key features builders and real estate bodies used to lure the buyers with to invest in the upcoming residential and commercial projects.
